Terms and conditions of sale

The present conditions apply to the sale of products by BHC SARL on its “online order” page accessible via the Internet. They are automatically made available to the buyer on the home page of the “energydrink.fr” website. The buyer simply clicks on “General Sales Conditions” (hereinafter referred to as G.S.C.) to find out the conditions of his order, even before he has begun the ordering process.


Consequently, the act of placing an order implies the buyer’s full and unreserved acceptance of these G.S.C.

The fact that the seller does not at a given time avail itself of any of the provisions hereof may not be interpreted as a waiver of its right to avail itself of any of the said conditions at a later date.

1) MINIMUM QUANTITY

Products are subject to minimum order quantities: packs of 24 for cans or packs of 6 for bottles. These minimums are clearly specified on the site for each of the references concerned.

2) PRICES

Prices are given in Euros ( € ) . All prices include VAT.

3) BILLING

A detailed invoice will be mailed to you upon delivery of your order. Invoices are issued in Euros ( € ). All bank payments are made in Euros ( € ).

4) SHIPPING COSTS

Free shipping.

5) MODE AND TIME OF DELIVERY

Delivery is made by our carrier to the address indicated by the customer at the time of payment (a notice of availability will be left if the customer is absent).

6) DELIVERY TIMES AND AVAILABILITY

BHC SARL usually expects a very short delivery time. This should not exceed 6 working days for France. In the event of unavailability of the product ordered, the consumer will be informed as soon as possible and will have the option of cancelling the order.

7 ) PAYMENT CONDITIONS

The customer’s only means of payment is the Paypal system (Mastercard or credit card). BHC SARL reserves the right to cancel or suspend any order in the event of non-payment or refusal to authorize payment by credit card by officially accredited organizations. Any order validated by a customer who has not paid in full for a previous order may be refused or suspended by BHC SARL.

8) TRANSPORT AND LIABILITY

Goods travel at your expense and risk. It is therefore your responsibility to check the contents of the package at the time of delivery and to express any reservations as follows: On the delivery slip provided by the carrier or by immediately calling the carrier’s customer service department, in the presence of the delivery person:

And, in all cases, by notifying the company “BHC SARL” by registered letter addressed to its head office 23 rue de gamand – 59810 Lesquin within three (3) days of receipt of the package.

9) PRODUCT RETURN

Your right:
Pursuant to Article L. 121-16 of the French Consumer Code, you may return the product, at your own expense, to the address of our head office indicated in Article 1, within seven (7) days of delivery, for exchange or refund, in good condition and in its original packaging with the original invoice.


BHC SARL” will only pay the return shipping costs (at the current base rate) if both of the following conditions are met simultaneously:

  • The delivery does not conform to the order.
  • You have made reservations with the carrier (see article 8: transport and liability).

10) RESERVATION OF OWNERSHIP

Until full and effective payment of the price, BHC SARL remains the owner of the goods sold. Payment in full shall constitute transfer of ownership. However, the purchaser shall become responsible for the items as soon as they are delivered, and transfer of possession shall constitute transfer of risk.

11) INFORMATION TECHNOLOGY AND CIVIL LIBERTIES

In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify, modify and delete data concerning you.

12) JURISDICTION

By placing an order, you irrevocably agree to be bound by all the terms and conditions of sale. In the event of disputes, the Lille court will have sole jurisdiction.
